Rules & Regulations/Distributor Application  Agreement

I, the undersigned applicant, understand and agree that:

1) For tax purposes, the applicant must provide taxpayer identification number (this is normally the applicant's social security number).  The taxpayer identification number must match the name of the application.  Only one taxpayer identification number per household and/or business can be accepted . Application must have your signature and your social security number or Federal tax Id number in order to process.

2) I am an independent contractor and not an employee, agent, or representative of Pure Herbs, Ltd. Therefore, I am solely responsible for my own business.

(3) I will obey all laws pertaining to the operation of my own business including, but not limited to, paying all fees and taxes due any local, state or federal agencies.

4) I will purchase product and conduct my business according to the procedure published in the Pure Hers, Ltd. Marketing Plan.

5) I will never make any claims, statements or advertisements concerning Pure Herbs, Ltd., or any of its products except those that have been officially approved in writing by the company. I understand that herbs and Pure Herbs, Ltd. Herbal products are foods and should be represented as such. They cannot be used to treat or cure conditions.

6) Due to F.D.A. regulations regarding food products, Pure Herbs, Ltd. Has a no return policy. The exceptions are breakage and manufacturing defects. This policy is necessary as the returned product must be destroyed due to F.D.A. regulations.

7) I may sponsor persons into the Pure Herbs, Ltd. Distribution Program without cost or investment, provided PURE HERBS, LTD. Accepts their application. PURE HERBS, LTD. reserves the right to deny any application for cause.

8) Pure Herbs, Ltd.. reserves the right to terminate this Distributor Agreement, upon 30 days prior written notice, should the undersigned violate any of the terms and conditions of this Distributor Agreement, any published rule of Pure Herbs, Ltd., or any of the provisions of the Pure Herbs, Ltd. Marketing Plan. Furthermore, Pure Herbs, Ltd. Reserves the right to set off against any monies due and owing to the undersigned by Pure Herbs, Ltd. any money due and owing by the undersigned downline or for any other violation of the undersigned of this Distributor Agreement or the aforementioned published rules or Marketing Plan of Pure Herbs, Ltd..

9) Pure Herbs, Ltd., Reserves the right to amend the Marketing Plan upon 30 days notice to existing Distributors.

10) Pure Herbs, Ltd. has an application fee of $35.00 (due when turning the application in to Pure Herbs, Ltd..) and a yearly Distributor’s renewal fee of $20.00 which shall be used to cover the cost of newsletter and material sent to the Distributor. The applicant is responsible for mailing or faxing this Distributor Application Agreement and his/her Distributor Application along with the application fee to the company. Pure Herbs, Ltd. Will not accept any altered application agreement forms.

11) I am eighteen years of age or older.

12.) Applications must be mailed or faxed in, we cannot take phone applications.

Also, all incomplete applications will not be processed & will be sent back to the applicant.  

DUE TO THE PRIVACY ACT, PURE HERBS, LTD. WILL NOT PROVIDE YOUR PERSONAL INFORMATION TO ANYONE OUTSIDE OF YOUR UPLINE.

YEARLY RENEWAL FEE

There is a $20.00 annual renewal fee. We use these fees to help cover informative newsletters. We send out renewal fee reminders, giving you plenty of time to renew. (It is very important, when moving, to give us your new address to keep our files current.) Once your renewal fee goes 90 days past due, you will automatically be removed from our data base. If this should happen, you will have to sign a new application and pay $35.00 to become a Distributor again. This means starting all over again; any people you have sponsored from your previous Distributorship will not be transferred to your new Distributorship. We hope by sending out renewal notices that this will help to keep everyone current with Pure Herbs, Ltd. It wouldn’t be a bad idea to keep track of your sign up date, just in case. After your expiration date, you have a 90 day grace period in which to renew your Distributorship or apply as a new Distributor. Until you do re-new or sign up again, you will not be able to order products, nor will your upline have to pay you a purchase volume discount bonus on products ordered from them.

THE LAST BUSINESS DAY OF THE MONTH

All orders and  P.V.T. (Purchase Volume Transfers), which refers to products that were ordered by Distributors that you did not sponsor.  MUST be called in, faxed or received by mail, before 5:30 p.m. E.S.T. on the last business day of the month.  We do not except orders by e-mail.  A good example of the last business day would be, if the 30th is a Sunday, the last business day would then be Friday the 28th.  All orders and P.V.T. faxed, mailed or left on the recorder after 5:30 p.m. E.S.T. on the last business day, will automatically go on the next month.   Legal holidays are not considered business days. Please keep in mind that Michigan changes to Daylight Savings Time in summer.  It is your responsibility to make sure orders are taken care of by 5:30 pm. our time. Please make note of this.  This could be very important to you or your downline, as it is your responsibility, and it will be your responsibility to correct any problems in your downline, should you fail to adhere to these rules. There are no exceptions. 

As a Director, it is also your responsibly to keep track of the products your Distributors buy directly from you. PV transfers can only be transferred from one Director to another. They must also be over $50.00. The only time a transfer would go to someone in your own downline is, if the transfer will make a Distributor into a Director, or be the first $1000.00 toward becoming a Director.

We publish our newsletters every other month. In our newsletters we announce new products, specials, seminars, and new rules and regulations. All new rules and regulations are published in our newsletters before they go into effect. Please, take time to review them, the newsletter holds much valuable information. The seminars listed in our newsletters are Pure Herb seminars, and are open to everyone.

You must be a Distributor to Purchase Products directly from us.

Should you not want to become a Distributor, we will be happy to have one of our Distributors contact you, so you may purchase products from them.

Please note that Pure Herbs, Ltd. is open Monday through Friday 9:00 a.m. till 5:30 p.m. Eastern Standard Time.  During the summer months we change to E.D.T. (eastern daylight savings time). It is your responsibility to note our time changes. At 5:30 p.m. we start our end of the day computer clean-up; so, we do lock our doors promptly at 5:30 p.m. and activate our voice mail system for your phone calls. If you need to place an order and it is not during business hours, please call our voice mail system. 

Our voice mail system has many options to choose from; make your selection and then leave a detailed message. Always leave your last name, phone number, distributor number, and method of payment (we accept Visa, MasterCard, Discover and American Express, or you can pay by C.O.D., check or money order only). 

If you have a rotary phone, stay on the line and you will have the opportunity to leave a message at the end. Also, please be aware that when all of our lines are busy you will automatically be transferred to our voice mail system.

ALL ORDERS HAVE SHIPPING CHARGES

1 ounce and 4 ounce bottles must be shipped separately in U.P.S. approved containers, each is a separate order. So, if you place a 1 ounce and a 4 ounce order at the same time, they each have to be shipped as separate orders with separate shipping charges. capsules can be put in either a 1 ounce or 4 ounce box. If only ordering capsules, shipping charges apply as below.

There is a charge of $5.00 per order for each drop-ship.

Also if you want to ship overnight, second day air, or third day ground you will just incur that cost and not our shipping too. 

(The products do not have to be all the same herb or combination, just the same size).

C.O.D. ORDERS HAVE A FEE OF $9.00. (Check or Money order only)

EXCEPTION INTERNATIONAL SHIPMENTS WILL BE AT THE DISTRIBUTORS EXPENSE.
